Abstract

Indonesian criminal law, rooted in legal positivism, tends to subsume the murder of women into the general homicide category (Article 338/340 of the Old Criminal Code or Article 458/459 of Law No. 1 of 2023). This categorization is gender-blind, thereby failing to capture power imbalances, gender-based motives, and pre-existing patterns of violence. This article aims to analyze the adequacy of homicide offense constructions in Law No. 1 of 2023, examine the conceptualization of gender motives in criminal liability, and formulate a socio-legal reconstruction of femicide in Indonesia. Employing a normative-socio-legal research methodology with conceptual, statutory, and case approaches, this study reveals that the absence of the term "femicide" in positive law stems from male bias and the epistemological limitations of legal positivism. Utilizing Feminist Legal Theory and Karl Mannheim's Sociology of Knowledge, this article recommends criminal law reforms through a Responsive Law approach that establishes gender motives and power dynamics as specific socio-legal categories or aggravating factors to ensure substantive justice for victims.
