Abstract

Article 39 of Law Number 3 of 2024 on Villages, which extends the term of office of village heads to eight (8) years, has the potential to further erode the quality of democracy in Indonesia. The extension of the village head’s tenure is feared to increase the risk of corruption within the village governance sector. The enactment of the 2024 Village Law has triggered social unrest and negative impacts on the democratic order at the village level, which may lead to the misuse of village fund allocations. The optimization of the role of village governments through this regulation stands in contrast to the reality of village development in many regions, which remains deeply concerning. This study employs library research with a normative juridical approach. The research is descriptive-analytical in nature, aiming to describe and analyze regulations relevant to the research topic. The normative juridical approach focuses on legal principles, legal systematics, and comparative law. The data sources consist of primary data in the form of statutory regulations, secondary data derived from legal literature and previous studies, and tertiary data such as dictionaries and encyclopedias used as supporting references. The findings of this study indicate that the extension of the village head’s term of office to eight years, as stipulated in Article 39 of Law Number 3 of 2024, has the potential to reduce the quality of democracy at the village level, particularly participatory democracy. This policy may limit opportunities for the community to periodically elect village heads, thereby increasing the risk of political stagnation and declining accountability of village officials. Moreover, a longer term of office provides village heads with greater opportunity to consolidate power, which may hinder leadership regeneration.
